Allgemeine Geschäftsbedingungen für den Online-Verkauf von Bildern:

 

 

1. Geltungsbereich

 

Die nachfolgenden Allgemeinen Geschäftsbedingungen gelten für alle Verträge zwischen dem Künstler (Verkäufer) und dem Kunden (Käufer) über den Online-Verkauf von Bildern auf der Webseite des Künstlers.

 

 

2. Vertragsabschluss

 

Der Vertrag kommt zustande, wenn der Käufer ein Bild auf der Webseite des Künstlers auswählt, in den Warenkorb legt, den Bestellprozess abschließt und die Zahlung erfolgt.

 

 

3. Preise und Zahlungsbedingungen

 

Die Preise für die Bilder sind auf der Webseite des Künstlers angegeben und sind gem. §19 des deutschen UstG ohne Mehrwertsteuer. Die Zahlung kann per Vorkasse, PayPal oder Kreditkarte erfolgen.

 

 

4. Lieferung und Versand

 

Die Lieferung der Bilder erfolgt gemäß folgenden Bestimmungen

 

Die Versandkosten trägt der Käufer.

 

 

5. Widerrufsrecht

 

Der Druck wird erst nach der Bestellung exklusiv für den Käufer produziert und bei einer Bestellung eines limitierten Druckes bzw. auf Kundenwunsch vom Künstler signiert. Dies ist besonders nachhaltig und gewährleistet die beste Qualität.

 

Die Waren nach Maßgabe des Kunden personalisiert angefertigt. Das gesetzliche Widerrufs- oder Kündigungsrecht, von dem alle Kunden Gebrauch machen können, die einen Fernabsatzvertrag eingehen, und das besagt, dass der Vertrag innerhalb von 14 Tagen ab Erhalt der Produkte ohne Angabe von Gründen oder die Entstehung von Mehrkosten widerrufen oder gekündigt werden kann, findet dadurch keine Anwendung. 

 

 

6. Gewährleistung

 

Der Verkäufer gewährleistet, dass die Bilder frei von Mängeln sind. Bei nachweislichen Mängeln hat der Käufer Anspruch auf Nachbesserung oder Ersatzlieferung.

 

 

7. Datenschutz

 

Der Verkäufer verpflichtet sich zur Einhaltung der datenschutzrechtlichen Bestimmungen und zur Vertraulichkeit der Kundendaten.

 

 

8. Anwendbares Recht und Gerichtsstand

 

Es gilt deutsches Recht. Gerichtsstand ist der Sitz des Verkäufers.

 

 

9. Schlussbestimmungen

 

Abweichungen von diesen AGB bedürfen der Schriftform. Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

General terms and conditions for the print shop

 

 

1 introduction

 

The following General Terms and Conditions apply to all contracts between the artist (seller) and the client (customer) for the online sale of art prints on the artist's website.

 

 

2 Contract

 

The contract comes into force when the customer selects a picture on the artist's website, places it in the shopping cart, completes the ordering process and makes payment.

 

 

3 Prices and terms of payment

 

The prices for the products on the artist's website are not containing VAT in accordance with §19 of the German Value Added Tax Act. Payment can be made by bank transfer, PayPal or credit card.

 

 

4 Delivery and shipping

 

The prints are delivered in accordance to the following conditions: Payment and Delivery Information.

 

The customer accounts for the shipping costs.

 

 

5. right of withdrawal

 

The print will be produced exclusively for the client after the order has been placed and will be signed by the artist if a limited edition print is ordered or at the customer's request. This is particularly sustainable and guarantees the best quality.

 

The goods are personalized according to the customer's specifications. The statutory right of withdrawal or termination, which can be exercised by all customers who enter a distance selling contract and which states that the contract can be withdrawn or terminated within 14 days of receipt of the products without giving reasons or incurring additional costs, does not apply.

 

 

6 Warranty

 

The seller warrants that the products are free from defects. If any proven defects should occur, the customer is entitled to rectification or replacement.

 

 

7. data protection

 

The seller undertakes to comply with the regulations of data protection law and to maintain the confidentiality of customer data.

 

 

8 Applicable law and place of jurisdiction

 

German law shall apply. The place of jurisdiction is the registered place of residence of the seller.

 

 

9. final regulations

 

All deviations from these terms must be made in writing. Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
